Terms & Conditions of Sale

1) A minimum deposit of 30% is required from the CUSTOMER. No goods will be ordered prior to receipt of deposit and signed contract.

2) Credit Cards are NOT accepted for final payment.

3) Actual freight charges shall be paid by the customer to the carrier upon delivery. Furniture and Leather is not responsible for any difference between estimated and actual freight charges.

4) Furniture and Leather is not responsible for Manufacturer's delays and does not guarantee delivery dates. A delivery date will be estimated in accordance with Manufacturer's Acknowledgment, but shall be subject to change without notice.

5) Customer may not cancel orders without prior consent from Furniture and Leather. No cancellations will be accepted by Furniture and Leather after the order is placed with the Manufacturer unless Furniture and Leather agrees to the cancellation in writing. In this case there will be a cancellation charge of 30% of the contract price and the contract balance will be used as a store credit only.

6) Balance of contract must be paid in full before delivery of goods. If customer fails to pay balance within 25 days of notification that furniture is ready for delivery. Furniture and Leather reserves the right to cancel this contract and retain Customer's deposit.

7) All goods are shipped FOB by Furniture and Leather and becomes Customers property upon delivery to the carrier. Responsibility for transit damage is with the delivery carrier. Delivery instructions for each carrier must be strictly adhered to. Customer agrees to inspect goods carefully for any damage and note any damage or shortage on the freight bill before the goods are accepted from the carrier. Customer is responsible for filing damage and shortage claims with the carrier. CUSTOMER IS RESPONSIBLE FOR INCREASED COST OF DELIVERY DUE TO SIZE OR WEIGHT OF GOODS, OR LIMITATIONS OF ACCESS AT DESTINATION.

8) Customer agrees to inspect all goods for manufacturing problems or failure to conform to the contract description immediately upon receipt of goods. Customer must notify Furniture and Leather of a claim nonconformity with contract description via telephone within 24 hours after receipt of goods and if requested by Furniture and Leather, submit a written claim, with photographs within 15 days thereafter. Furniture and Leather's obligation if a manufacturing problem exists or in a case of nonconformity with the contract description is limited to repair or replacement, at Furniture and Leather's option.

9) Terms and Conditions are subject to change without notice.
